Resisting Immigration Detention
2016
The aim of this article is to provide a normative analysis of the ways in which immigrants resist immigration detention. After having outlined (in Section 2) some general features that make immigration detention a rather abnormal condition for human beings to be kept in, I distinguish three main forms of resistance to it: institutionalized, non-institutionalized, and anti-institutional. I first spell out, in Section 3, some individual characteristics of these forms of resistance. Then (in Sections 4 and 5), using Italy as my test case, I suggest, for each of these forms, an interpretation of their normative meaning (that is, their meaning according to both the relevant legal rules and their…
Witnessing the experience of European bordering: Watching the documentaryUnder den samme himmelin an immigration detention centre
2017
This article draws on theories of bordering and mediated witnessing to examine a documentary film that mediates migrants’ experiences of bordering in Europe. My analysis of Under den samme himmel/Days of Hope shows how the film captures the multiplicity of bordering practices, from geographical to socio-cultural borderings. The analysis is informed by watching and discussing the film in an immigrant detention facility in Finland with people who experienced and eye-witnessed experiences similar to those depicted in the film. This creates a sense of co-presence of the experiential landscapes in the border zones, and the film invites viewers to consider borders not as lines in the landscape, b…
Immigration detention i…
The Long Route Towards a Widespread European Culture of Alternatives to Immigration Detention
2016
The aim of this article is to provide an analysis of the application by some European Union countries of alternative measures to detention of migrants. Sections 2 and 3 indicate, in line with European normatives and with detention being a measure of last resort, that Member States having ascertained that there are grounds for the detention of migrants, should evaluate whether the aims pursued can be achieved through a less coercive measure which respects the fundamental rights of individuals. Unfortunately, as examined in Section 4, analysis of most European countries’ law reveals an unsatisfactory application of alternative measures to detention. As in, for example, Italy’s case, whose leg…
Una > forma di detenzione per l'identificazione dei migranti. Note a margine del d.l. n. 13/2017
2017
Introduction: The Criminalization of Migration and European (Dis)Integration
2016
This Special Issue of European Journal of Migration and Law is devoted to analysing some relevant facets of the conflict, which we see at the heart of the current European approach to migration, between criminalization of migrants and migrants’ rights. But it is also devoted to outlining some strategies and practices through which the conflict might be avoided, or at least overridden. The papers focus on different facets of this overarching subject by adopting a European (EU and ECHR) perspective, as well as the perspective of specific MSs. Three domestic systems, in particular, are taken into consideration—the UK, France and Italy—and compared with the relevant European standards concernin…
Lessons learnt from TB screening in closed immigration centres in Italy
2016
Background Between June 2012 and December 2013 Médecins Sans Frontières launched a pilot project with the aim of testing a strategy for improving timely diagnosis of active pulmonary TB among migrants hosted in four centres of identification and expulsion (CIE) in Italy. Methods This is a descriptive study. For active TB case finding we used an active symptom screening approach among migrants at admission in four CIE's. Here we describe the feasibility and the yield of this programme. Results Overall, 3588 migrants were screened, among whom 87 (2.4%) had a positive questionnaire. Out of 30 migrants referred for further investigations, three were diagnosed as having TB, or 0.1% out of 3588 i…
